This can be achieved by researching issues and problems, interviewing users concerning their problems and needs, observing issues and problems and holding group discussions about user needs, issues and problems.
It is a creative thought or conception, that is the productof mental activity or of the conscious mind.
This is done by the completion of the design thinking process.
It refers to creations of the mind, such as, inventions, literary and artistic works, and symbols, names and images used in commerce.
Design thinking is related to IP via the refinement of a conceived idea that becomes a viable candidate for filing an IP application for a patent, copyright, trademark and/or trade secret.
The primary IP types are 1) copyrights, 2) trademarks, 3) trade secrets and 4) patents.
This can come from research, experience, and from an experienced IP attorney and/or a patent agent.
Any potential inventor can perform a search on their own, however, it would be better if an IP attorney and/or patent agent perform the search. This cuts down on time, cost and provides the best professional know-how on searching.
The best time to file an IP application is when an IP search, especially an extensive one, has been performed. The filing for a patent, trademark and/or copyright occurs when all the filing documents are completed, and the IP guidelines and laws have been fully satisfied. The filing is best when everything is taken care of by a licensed attorney and/or licensed patent agent.
The process for moving a patented product to market or commercialization is called technology transfer. This should be handled by attorneys, patent agents, tech transfer agents, investors, marketing specialists, and/or brokers that have the necessary experience and know-how to make this come to fruition. However, the inventor could handle such, if they have the required know-how.
